Informace o soutěži:
Tato pravidla závazně upravují úplné podmínky Velké vánoční soutěže o 3x single poukaz B na jízdu v Surf Areně v hodnotě 1190 Kč (dále jen „Soutěž“), která probíhá na Facebook a Instagram profilu Surf Areny, který provozuje Pořadatel (dále jen „Profil“).
Soutěž probíhá na území České republiky (dále jen „místo konání Soutěže“) od 24.11.2021 do 4.12. 18:00 (dále jen „doba konání Soutěže“). Vyhlašování výherců bude probíhat na IG a FB profilu Pořadatele v komentářích u soutěžního příspěvku.
Podmínky zapojení do Soutěže:
Soutěže se může zúčastnit každá fyzická osoba starší 18 let, která má adresu pro doručování v České republice a zřízený vlastní aktivní profilový účet na sociální síti Instagram nebo Facebook a splní tyto podmínky Soutěže (dále jen „Soutěžící“).
Soutěžící musí být po dobu trvání Soutěže zaregistrovaným uživatelem s aktivním účtem na Instagramu a splňovat veškerá pravidla jeho užití. Zanikne-li z jakéhokoliv důvodu Instagram účet Soutěžícího, může Organizátor Soutěžícího ze Soutěže vyřadit.
Každý Soutěžící se smí účastnit pouze jediným Instagram a/nebo Facebook účtem. Použije-li totožný Soutěžící více Instagram/Facebook účtů k účasti v Soutěži, budou všechny jeho odpovědi ze všech takových účtů ze Soutěže vyřazeny. Zakázáno je účastnit se Soutěže skrze Instagram/Facebook účet jiné osoby, i v takovém případě budou odpovědi Soutěžícího vyřazeny.
Organizátor může podle svého uvážení vyřadit ze Soutěže jakéhokoliv Soutěžícího, který porušuje pravidla Soutěže nebo pokud k tomu má důvodné podezření. V případě vyřazení Soutěžícího ze Soutěže nemá Organizátor povinnost uvádět důvody takového rozhodnutí a vyloučenému Soutěžícímu nevzniká vůči Organizátorovi ani Pořadateli žádný právní nárok.
Organizátor či Pořadatel může vyloučit ze Soutěže také Soutěžícího, u kterého bude mít podezření, že dosáhl výsledku v Soutěži podvodným způsobem ovlivnitelným výsledky Soutěže.
Určení výherce:
Soutěže se mohou Soutěžící zúčastnit splněním soutěžního úkolu – vložením soutěžního komentáře (popis nejlepšího a nejhoršího dárku, jaký kdy soutěžící k Vánocům dostal) k příspěvku Pořadatele na Profilu (dále jen „Soutěžní úkol“).
Výhercem se stane Soutěžící, který podle pokynů Organizátora splní Soutěžní úkol a bude vylosován v sobotu 4.12.
V Soutěži je možné získat věcnou cenu v podobě: poukazu single B (dále jen „Výhra“). Celkem budou vylosováni 3 výherci. Podrobné informace o výhře jsou specifikovány u daného příspěvku na Profilu.
Jméno Výherců vyhlásí Organizátor na IG a FB Profilu Surf Areny.
V případě neočekávaných komplikací může Pořadatel nahradit Výhru jinými věcnými cenami stejné i nižší hodnoty. Výherce Soutěže nemá právo po Organizátorovi ani Pořadateli požadovat žádná finanční ani jiná plnění.
V případě, že se ukáže, že Výherce nemá z jakéhokoliv důvodu nárok na Výhru nebo Výhru odmítne, mohou Organizátor i Pořadatel použít Výhru k jiným účelům. Nárok na Výhru nelze převádět na jiného Soutěžícího nebo jinou osobu.
Soutěžící si je vědom, že na účast v Soutěži ani na Výhru nemá právní nárok, tedy je nemůže právně vymáhat. Výhry nelze proplácet v hotovosti nebo požadovat výměnu za jiné zboží.
Organizátor ani Pořadatel nenesou odpovědnost za to, že se informace o získání Výhry k Výherci nedostane, ani za případné nedoručení, ztrátu nebo poškození Výher.
Jak proběhne předání Výhry:
Výhra v Soutěži bude předána dle domluvy po kontaktování Surf Areny výherci na info@surfarena.cz.
V případě, že si Výherce Výhru nepřevezme nebo jinak neposkytne součinnost v rámci předání Výhry, nemůže vydání Výhry dále požadovat a je zcela na Organizátorovi a Pořadateli, zda použijí Výhru k jiným účelům.
Ochrana osobních údajů Soutěžících a Výherce:
Zapojením do Soutěže souhlasí Soutěžící se zpracováním osobních údajů Organizátorem, které jsou potřebné pro účast v Soutěži, evidenci Soutěžících, vyhodnocení Soutěže, komunikaci s Výhercem a předání Výhry, tj. zejména jméno a příjmení podle Instagram a/nebo Facebook profilu Soutěžícího, případně další údaje, které Soutěžící sdělí Organizátorovi. Organizátor je správcem osobních údajů ve smyslu nařízení Evropského parlamentu a Rady (EU) č. 2016/679 o ochraně fyzických osob v souvislosti se zpracováním osobních údajů a o volném pohybu těchto údajů a o zrušení směrnice 95/46/ES (obecné nařízení o ochraně osobních údajů) (dále jen „Nařízení“), a tyto údaje bude zpracovávat na dobu nezbytně nutnou pro uspořádání Soutěže a případnou kontrolu. Toto zpracování je odůvodněno článkem 6 odst. 1 písm. a) Nařízení. Bez tohoto souhlasu se Soutěže nelze zúčastnit.
Soutěžící může vzít souhlas se zpracováním osobních údajů pro uvedené účely kdykoliv zpět na adrese Surf Areny. V případě jeho zpětvzetí však nebude možné vyhodnotit jeho účast v Soutěži nebo jej informovat o Výhře.
V případě Výherce budou osobní údaje (jméno, příjmení, e-mail, poštovní adresa a telefonní číslo) dále zpracovávány po dobu nezbytně nutnou pro doručení Výhry a dále po dobu 3 let konce doby konání Soutěže za účelem evidence předání Výhry.
Soutěžící uděluje pro případ získání Výhry bezplatné svolení s užitím své podobizny, jména, příjmení nebo kombinace jména a příjmení dle osobního Instagram a/nebo Facebook profilu v hromadných sdělovacích prostředcích, na internetu nebo v propagačních materiálech Organizátora nebo Pořadatele, a to po dobu konání Soutěže a dále po dobu 3 let od konce doby konání Soutěže.
Do zpracování osobních údajů je zapojen též další zpracovatel:
Pořadatel Soutěže, případně další poskytovatelé zpracovatelských softwarů, služeb a aplikací, které však v současné době správce nevyužívá.
Soutěžící má v souladu s Nařízením tato práva:
- požadovat informaci, jaké jeho osobní údaje Organizátor zpracovává,
- vyžádat si přístup k těmto údajům a tyto nechat aktualizovat nebo opravit, popřípadě požadovat omezení zpracování,
- požadovat výmaz těchto osobních údajů,
- právo vznést námitku, pokud budou údaje zpracovávány na základě oprávněného zájmu Organizátora,
- na přenositelnost údajů a právo požadovat kopii zpracovávaných osobních údajů,
- podat stížnost u Úřadu pro ochranu osobních údajů,
- na účinnou soudní ochranu, pokud má za to, že jeho práva podle Nařízení byla porušena v důsledku zpracování jeho osobních údajů v rozporu s tímto Nařízením.
Ostatní ustanovení
Svou účastí v Soutěži souhlasí každý Soutěžící s těmito soutěžními podmínkami, které jsou zveřejněny na webu surfarena.cz, a zavazuje se je dodržovat.
Tato Soutěž není žádným způsobem sponzorována, podporována či spravována Facebookem/Instagramem ani s ním není spojena.
Pořadatel ani Organizátor neodpovídají za funkčnost Facebooku/Instagramu, Profilu nebo za technické problémy při přenosu dat prostřednictvím sítě internet.
Organizátor i Pořadatel Soutěže jsou oprávněni jednostranně bez náhrady změnit pravidla Soutěže i v průběhu jejího trvání, např. zkrátit ji, přerušit, zrušit, změnit předmět Výhry. V případě změny pravidel Soutěže nahraje Pořadatel jejich aktuální znění na příslušnou webovou stránku, která informuje o Soutěži.

(hereinafter referred to as the ‘Organiser’)
II. Information on the Competition:
1. These rules constitute the entire binding terms and conditions of the “Big Christmas Contest” (hereinafter referred to as the ‘Competition’), held on the Surf Arena Instagram and Facebook profile that is organised by the Promoter (the ‘Profile’).
2. The Competition shall be held in the Czech Republic (hereinafter referred to as the ‘Competition Venue’) from 24.11. until 4.12. 2021 (18:00) (hereinafter referred to as the ‘Competition Date’).
III. Conditions of Participation in the Competition:
1. Any natural person older than 18 years of agehaving a correspondence address in the Czech Republic and an active Instagram or/and profile and complying with these Competition Terms and Conditions may participate in the Competition (hereinafter referred to as the ‘Competitor’).
2. Competitors shall be registered users having an active Instagram account for the entire duration of the Competition and complying with all its Terms of Service. If a Competitor’s Facebook/Instagram account terminates, the Organiser may exclude the Competitor from the Competition.
3. Each Competitor may participate in the Competition via one Instagram and/or Facebook account only. If any Competitor uses multiple Instagram or/and Facebook accounts to participate in the Competition, all the Competitor’s answers received from these accounts shall be excluded from the Competition. Participation in the Competition via other person’s Instagram and/or Facebook account is forbidden and shall result in the Competitor’s answers being excluded from the Competition.
4. The Organiser may, at its own discretion, exclude from the Competition any Competitor that is in breach of the Competition rules or if there is a reasonable suspicion of violation thereof. The Organiser shall not be obliged to give the reasons for excluding Competitors from the Competition, and any excluded Competitors shall not be entitled to raise any legal claims against the Organiser or the Promoter in this context.
5. The Organiser or the Promoter may also exclude from the Competition a Competitor suspected of participating in the Competition in a fraudulent way, capable of affecting the Competition results.
IV. Determination of the Winner:
1. Competitors may participate in the Competition by fulfilling the competition task – by entering a competition comment (name of the chosen workshop) below the Promoter’s post on a Profile (hereinafter referred to as the ‘Competition Task’).
2. The Winner shall be the Competitor who fulfils the Competition Task in line with the Organiser’s instructions and drawn 4th Dec at 18:00 (hereinafter referred to as the ‘Winner’).
3. A material prize in the form of: free single B ride in Surf Arena. There will be 3 winners in total. Details concerning the Prize are provided in the given post on the Profile.
4. The Winner’s name shall be announced by the Organiser on the Profiles.
5. If unexpected inconveniences arise, the Promoter may replace the Prize with other material prizes of the same or lower value. The Winner of the Competition shall not have the legal right to claim that the Organiser or the Promoter fulfil their financial or other obligations.
6. If the Winner is proved to be lack the entitlement to the Prize for any reason or if the Winner refuses to accept the Prize, the Organiser and the Promoter may use the Prize for other purposes. The entitlement to the Prize must not be assigned to any other Competitor or a third party.
7. The Competitor acknowledges the absence of any legal claim to the participation in the Competition and/or the Prize and, therefore, the Competitor shall not take legal action to enforce these claims. The Prize shall not be provided in cash and the Winner may not require its replacement with other goods.
8. Neither the Organiser nor the Promoter shall be responsible for informing the Winner about winning the Prize, or for any non-delivery and loss of or damage to the Prize.
V. Handover of the Prize:
1. The Competition Prize shall be handed over after contacting Surf Arena by the winner at info@surfarena.cz and discussing the details.
2. If the Winner fails to take over the Prize or in any other way fails to cooperate in handing over the Prize, the Winner subsequently shall not request the Prize and it is entirely at the Organiser’s and the Promoter’s discretion whether or not to use the Prize for other purposes.
VI. Protection of Competitors’ and Winner’s Personal Data
1. By participating in the Competition, Competitors agree that the Organiser may process their personal data needed for their participation in the Competition, keeping records of Competitors, evaluation of the Competition, communication with the Winner and the handover of the Prize, i.e. name and surname in line with the Competitor’s Instagram profile, or any other data communicated to the Organiser by the Competitors. The Organiser is a personal data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the ‘Regulation’) and shall process the data for the period needed to organise the Competition and for any subsequent checks, if necessary. The personal data processing is based on Article 6(1)(a) of the Regulation. Participation in the Competition shall not be possible without this consent.
2. The Competitor shall have the right to withdraw its consent to personal data processing for the stated purposes at any time by writing to the following address: info@surfarena.cz. However, if the Competitor withdraws its consent, it will not be possible to evaluate its participation in the Competition or to inform the Competitor on winning the Prize.
3. The Winner’s personal data (name, surname, email, correspondence address and telephone number) shall be processed for the period needed for the delivery of the Prize and, subsequently, for the period of 3 years following the termination of the Competition, to keep records regarding the handover of the Prize.
4. The Competitor who wins the Prize agrees to the use of his/her photo, name, surname or the combination of his/her name and surname in line with his/her personal Facebook/Instagram profile in mass media, on the Internet or in the Organiser’s or Promoter’s promotional materials for the duration of the Competition and, subsequently, for the period of 3 years following the termination of the Competition.
5. The personal data shall be processed by third parties:
the Promoter of the Competition, or any other providers of software, services, and applications that are not currently used by the personal data controller.
6. Under the Regulation, the Competitor is entitled to:
- request the Organiser to inform the Competitor what Competitor’s personal data the Organiser processes,
- request access to the personal data and have them updated or rectified, or require the restriction of processing,
- request the erasure of such personal data,
- object to processing if the data is processed on the grounds of the Organiser’s legitimate interest,
- data portability and to obtain a copy of the processed personal data,
- lodge a complaint with the Office for Personal Data Protection,
- obtain effective judicial redress if the Competitor believes that the Competitor’s rights under the Regulation are violated as a result of the personal data being processed contrary to the Regulation.
VII. Miscellaneous
1. By participating in the Competition, each Competitor agrees to these Competition Terms and Conditions, which are published on the movingworld.cz website, and undertakes to observe them.
2. This Competition is in no way sponsored, supported or managed by nor associated with Facebook/Instagram.
3. Neither the Organiser nor the Promoter is responsible for the functionality of Facebook/Instagram, the Profile or for technical problems when transmitting data via the Internet.
4. The Organiser and the Promoter of the Competition are entitled to unilaterally change the rules of the Competition during the period of the Competition without a refund, e.g. to shorten, interrupt or cancel the Competition, or to change the subject of the Prize. If the rules of the Competition are changed, the Promoter shall upload the current version thereof to the relevant website providing information on the Competition.
